1.0 IMPORTANT LEGAL NOTICE

1.1 ATTENTION: This notice is issued by The Relationship Clinic Wales. This legal notice applies to the entire contents of these terms and conditions on the website under the domain name relationship.clinic.wales and clinic.wales and to any correspondence or contact between us and you. Please read these terms carefully before accessing and using the counselling services provided by The Relationship Clinic Wales. Using our services indicates that you accept these terms. If you do not accept these terms, do not use our counselling services. By accessing any part of our services, you shall be deemed to have accepted this legal notice in full. If you do not accept this legal notice in full, you should not use our counselling services. The Relationship Clinic Wales may revise this legal notice at any time by updating these terms and conditions. You should check the website from time to time to review the then current legal notice, because it is binding upon you. Certain provisions of this legal notice may be superseded by expressly designated legal notices or terms located on particular pages at the website.

1.2 This legal notice shall be governed by and construed in accordance with the laws of Scotland, Northern Ireland, English and Wales. Disputes arising in connection with this legal notice shall be subject to the exclusive jurisdiction of the English and Welsh Courts.

2.0 PAYMENT

2.1 Payment for a counselling session is to be made in advance of that session, or paid in advance for a set number of sessions. Cash, bank transfer, PayPal, credit and debit cards are the forms of payment I currently accept. Payments made for rescheduling and cancellation cover is non-refundable as it is a digital product. Payments made for the UnityQuest Programme is non-refundable as it is a digital product. A payment confirmation email is your receipt for any transaction on our website.

2.2 I will endeavour to give you as much advance notice as possible in terms of holidays or of any other need to cancel a future appointment. Typically I provide at least 48 hours notice of any change to appointments via SMS text, or email, or telephone, or in person. I reserve the right to cancel a session right up until the start time of a session. Under these circumstances I offer a full refund or an alternative appointment date. I will not be held responsible for any costs other costs that you or your partner incur due to a cancellation.

2.3 Whilst I make every effort to provide professional counselling services I understand that very occasionally these services may not meet your expectations. If you wish to dispute the quality of a particular counselling session then this should be via phone, text, letter, email or the contact form on this website within 14 days of the counselling session in dispute. I will then consider your request and if appropriate will arrange a refund for the session in dispute.

3.0 DIGITAL PRODUCTS, CANCELLATIONS, MISSED AND LATE SESSIONS POLICY

3.1 By consenting to these terms and conditions you provide us with your express consent to waive your rights under the UK Consumer Contracts Regulations in relation to the 14 day cancellation period for the purchase of digital products. This includes the Relationship Health Check Report digital product, Rescheduling & Cancellation Cover product, and the UnityQuest Programme product provided via the website clinic.wales or relationship.clinic.wales. By consenting to these terms you also acknowledge that once you receive digital email delivery of the Relationship Health Check Report product, Rescheduling & Cancellation Cover product, and UnityQuest Programme product, you will lose your right to cancel the purchase of this digital product and will not be eligible for a refund on this digital product.

3.2 When a counselling session has been purchased along with Rescheduling & Cancellation Cover you will be able to reschedule your session right up to the time of the appointment via your Client Account webpage on the website, without incurring any charges. To cancel a session when you have purchased a session together with Rescheduling & Cancellation Cover please contact us by phone, text or email.

3.3 If you are unable to attend your appointment session then please let us know as soon as possible, preferably by phone or text, or the contact form on our website. The required notice for cancellation is at least 24 hours. Where there is less notice, or if you fail to attend your appointment, then I reserve the right to charge the full fee for the session. I hope you appreciate that it is rarely possible to fill these appointments at such short notice which is why I may charge for my lost counselling time.

3.3 If you arrive late for your session, I reserve the right to finish the appointment at the correct time as there may be an appointment following yours which will need to start on time. In these circumstances I would require you to pay the full agreed cost of the session.

3.4 If before or during a session the technology you are using, for example a phone or laptop together with broadband connection, has a technical issue which prevents the session from commencing or completing, then I reserve the right to charge you for the full agreed cost of the session.

4.0 CONFIDENTIALITY

4.1 Confidentiality is an integral part of counselling and psychotherapy and is seen as essential to building the therapeutic relationship and ensuring your sense of safety. The therapeutic process encourages the client to be as open and honest as possible and inevitably your experiences and personal sensitive information can be disclosed.

4.2 It is therefore vital that you can trust that everything discussed with me will remain completely confidential. The only circumstances where I may share your personal information would be if there was a serious risk to your life, or if another person’s life was at risk, or in the rare instance where I was liable to civil or criminal court proceedings if I did not disclose your information.

4.3 If I believe that there is any risk in relation to your life or wellbeing I reserve the right to request from you the name and address of your General Practitioner (Doctor) in order for the counselling process to continue safely.

4.4 I reserve the right to ask for identification in the form of a driving licence or passport if I need to confirm your age (over 18) or residency status (UK Resident). See the restrictions to service in Section 7.0 below.

5.0 STORAGE AND HANDLING OF PERSONAL INFORMATION

5.1 The Relationship Clinic Wales stores the following personal information electronically; your first name; your telephone number and email address; the date of future and past appointments; your responses to questions in surveys and exercises; and the date that I brought your attention to these terms and conditions on our website. I also store the following details in relation to payment transactions; date; time; payment method; payment amount; any payment account reference passed by the payment provider; session type. Any information you may have submitted via surveys used in the counselling process (including survey results) is retained for your benefit. You can delete this survey data at any time after your first session has been completed via the Your Account - Your Reports - individual report pages on our website. The Relationship Clinic Wales reserves the right to retain anonymised client survey data for statistical purposes.

5.2 I will not make or store any notes or records during your counselling session and will not make or store any notes about your sessions at any other time except in relation to requirements under section 4.2 above. I will not make or keep any electronic recordings of your counselling sessions and ask that you do not do so as well. If you make any electronic recordings of the sessions that will be considered a breach of these terms and conditions.

5.3 The Relationship Clinic Wales endeavours to provide counselling services that comply with the Data Protection Act 1998 and the General Data Protection Regulations (EU) 2016/679. Our general policy on protecting your data is - that I cannot share your data inappropriately if I don't store it - so I minimise the information that I store to the bare minimum required to deliver our services.

5.4 The payment services providers that I use, PayPal for example, may ask for and store other personal information such as your address. You will need to consult and agree with their terms and conditions in order to use those payment services. This is a separate agreement to the one you have with The Relationship Clinic Wales.

5.5 The communication service providers that we use for counselling sessions, for example WhatsApp, Microsoft, Zoom, Google, may ask for and store personal sensitive data about you and may record information about your communications. You will need to consult and agree with their terms and conditions in order to use those communication services. This is a separate agreement to the one you have with The Relationship Clinic Wales.

5.6 If there is a clear indication that you do not wish to continue with couples counselling your data will be deleted within 7 days of this becoming apparent. A clear indication would include an SMS text, an email, a telephone conversation, or a video call from you where you indicate that you no longer require counselling.

5.7 You can close your online account with us at any time via the Your Account - Close Account page. This will remove all your personal identification information including your name and contact details. Your survey submissions will be anonymised and may be later used by us in an aggregated form for statistical research. Please contact us if you don't want your anonymised data to be used in this way and we will arrange for its deletion.

5.8 By providing an email address and a mobile telephone number you provide consent to allow us to use this information to contact you in relation to the counselling services that we provide. This includes consent to send messages via email, SMS, and messaging services such as Zoom, WhatsApp, Teams. Your removal of consent to use these communication methods may result in us no longer being able to provide you with counselling services.

5.9 By providing an email address and/or a mobile telephone number on behalf of your partner, you confirm to us that you have their consent to provide us with this information. You also consent on their behalf to allow us to use this information to contact your partner in relation to the counselling services that we provide. This includes consent to send messages via email, SMS, and messaging services such as Zoom, WhatsApp, Teams. Your Partner's removal of consent to use these communication methods may results in us no longer being able to provide you with counselling services.

6.0 HEALTH CARE DISCLAIMER

6.1 The counselling services provided by The Relationship Clinic Wales are offered to provide help and advice in relation to your non-health related lifestyle choices. Nothing in the services provided should be considered, or used as a substitute for medical advice, diagnosis or treatment. The services offered do not constitute the practice of any medical, nursing or other professional health care advice, diagnosis or treatment. You should always talk to your General Practitioner for diagnosis and treatment, including your specific medical and mental health needs. None of the services offered by The Relationship Clinic Wales represent or warrant that any particular service offered by The Relationship Clinic Wales is safe, appropriate or effective for you. I advise you to always seek the advice of a physician or other qualified health care professional with any questions regarding personal health or medical conditions. If you have, or suspect that you have a medical problems or condition, please contact your General Practitioner immediately. If you are in the United Kingdom and are experiencing a medical emergency, please call 999 on the nearest telephone.

6.2 Any results and/or reports and/or products that are derived/computed/calculated from information that you have input into surveys and/or any other forms on the website relationship.clinic.wales, should be treated by you as for entertainment purposes only. Any results and/or reports and/or products delivered by the website should not be mistaken for medical services and/or health care advice. This includes the Relationship Health Check product and the UnityQuest Programme product.

7.0 RESTRICTIONS

7.1 The Relationship Clinic Wales can only provide services to clients over the age of 18 who are resident in United Kingdom.

8.0 LIABILITY

8.1 The Relationship Clinic Wales and any other party (whether or not involved in creating, producing, maintaining or delivering the website or counselling services), exclude all liability and responsibility for any amount or kind of loss or damage that may result to you or a third party (including without limitation, any direct, indirect, punitive or consequential loss or damages, or any loss of income, profits, goodwill, data, contracts, use of money, or loss or damages arising from or connected in any way to business interruption, and whether in tort (including without limitation negligence), contract or otherwise) in connection with the website or counselling services or digital products in any way or in connection with the use, inability to use or the results of use of the website or counselling services or digital products, including but not limited to loss or damage due to your use of the services.

8.2 The counselling services provided by The Relationship Clinic Wales are provided "as is", without any conditions, warranties or other terms of any kind. Accordingly, to the maximum extent permitted by law, The Relationship Clinic Wales provides you with the counselling services and digital products on the basis that The Relationship Clinic Wales excludes all representations, warranties, conditions and other terms (including, without limitation, the conditions implied by law of satisfactory quality, fitness for purpose and the use of reasonable care and skill which, but for this legal notice, might have effect in relation to the services).

8.3 The Relationship Clinic Wales accepts no liability for any loss or damages associated with relationship and/or lifestyle advice provided via counselling services or via digital products or via the website at relationship.clinic.wales and clinic.wales.

8.4 Nothing in this legal notice shall exclude or limit The Relationship Clinic Wales's liability for:

  • (a) death or personal injury caused by negligence [(as such term is defined by the Unfair Contract Terms Act 1977; or
  • (b) fraud; or
  • (c) misrepresentation as to a fundamental matter; or
  • (d) any liability which cannot be excluded or limited under applicable law.

9.0 GLOSSARY OF TERMS

  • 'You, your, yours, client' - refers to you as the receiver of paid for goods and/or services from The Relationship Clinic Wales.
  • 'Your partner' - refers to a person that you identify as the receiver of paid for goods and/or services from The Relationship Clinic Wales as a partner in conjunction to services you recieve from us.
  • 'I, me, my, myself, us, our' - refers to The Relationship Clinic Wales and/or goods and/or digital products and/or services provided by The Relationship Clinic Wales.
  • 'The Relationship Clinic Wales' - is the trading name used by Carbon Machine Limited (Company No. 12221076), 40 Burnet Drive, Pontllanfraith, Blackwood, NP12 2FN, United Kingdom.
  • 'Counsellor' - refers to anyone who provides you with counselling services from The Relationship Clinic Wales.
  • 'Counselling' - refers to the help and advice services provided to you by a counsellor from The Relationship Clinic Wales.
  • 'Session' - refers to a counselling meeting which has been agreed verbally, electronically, by text, or in writing, whether or not it is attended. The time, duration, and location of the session will be agreed mutually between you and your counsellor.
  • 'The website' - refers to the website under the domain names relationship.clinic.wales or clinic.wales and www. domain variations of.
  • 'The service, the services' - refers to the counselling services provided by The Relationship Clinic Wales.
